A recurring conversation with Indian exporters goes like this. They tell us they have CE certification. We ask to see it. They produce a document from a testing organisation, with a logo, headed CE Certificate.

Then we ask for their declaration of conformity and their technical file, and there is a pause.

What has usually happened

They engaged a laboratory to test their product. The laboratory tested it against one or more standards and issued a report. Alongside the report, or instead of it, they issued something styled as a certificate.

The testing may be perfectly competent. The document is not what the exporter believes it to be.

What that document is and is not

It is evidence that a sample of the product was tested against the standards named, on a date, with a result. That is genuinely useful and it is an input to conformity assessment.

It is not a conformity assessment. It does not establish which legislation applies to your product, whether you have addressed every essential requirement, or whether the standards tested against are the right ones and sufficient.

It is not a declaration of conformity. Only the manufacturer can make that, and only the manufacturer signs it.

It does not confer any right to affix the CE marking.

For product categories requiring notified body involvement, a genuine notified body certificate does exist and carries a specific meaning, issued by a body with a four digit identification number designated under the relevant legislation. That is different from a laboratory test certificate, and confusing the two is the expensive version of this mistake.

Why this costs money

Because the exporter believes they are compliant and they are not.

The failure surfaces when a European customer's compliance function asks for the declaration of conformity and the technical file. The exporter cannot produce them. The shipment stops, or the customer relationship suffers, or in the worst case a product already on the market has to be withdrawn.

By then the remediation happens under commercial pressure, which is the most expensive way to do it.

The three questions to ask yourself

Which European legislation applies to my product? If you cannot list it, no certificate helps.

Have I drawn up and signed a declaration of conformity? If not, you have not CE marked your product regardless of what documents you hold.

Do I hold a technical file, and could I produce it on request?

Those three define whether you have done this. The test report supports them; it does not replace them.

What to do if this describes you

Do not panic, and do not throw away the testing. It is likely useful.

Establish which legislation applies, determine the correct conformity assessment route, check whether the testing performed covers what that route requires, fill the gaps, compile the technical file, and sign the declaration.

Often the testing already done covers a substantial part of it, and the work is completing an assessment rather than starting one.

And be careful about who you buy compliance services from. Any organisation offering to issue you a CE certificate for a self declaration product is either using the term loosely or selling something that does not exist. Ask them directly whether they are a notified body designated for your product legislation, and what their identification number is.

What this covers

See how this looks as a working system

Reading about a requirement and seeing the documentation that satisfies it are different things. In a short demo we open the actual manual, procedures and records set for CE Mark, show you how each clause is answered and where your existing way of working already fits. You will know what implementation involves before you commit to it.
